New Jersey doctor to be extradited to Maryland in abortion case (Reuters)

BALTIMORE (Reuters) ? A New Jersey doctor facing murder charges stemming from the alleged abortion of late-term fetuses will be extradited to Maryland in the coming days, a New Jersey court spokesman said Wednesday.

Steven Chase Brigham, 55, who is charged in Maryland with five counts of first-degree murder and other charges, waived his right to an extradition hearing, said Jason Laughlin, a spokesman for the Camden County, New Jersey, prosecutor's office.

He was arrested on December 28, and his case could be the first to test Maryland's fetal homicide law.

The investigation into Brigham and an employee, Nicola Riley, who is charged with one count of first-degree murder, began in August 2010 following a botched abortion in Elkton, Maryland, where Brigham and Riley were present, police said.

Officers who searched the Maryland clinic during an ensuing investigation found 35 fetuses in a freezer, a source said.

Maryland prosecutors have declined to comment on how the murder charges are tied to the botched abortion or the frozen fetuses.

Maryland criminal law states that people can be charged with murder if they "intend to cause the death of the viable fetus." Its state law defines a fetus as "viable" if "there is a reasonable likelihood of the fetus' sustained survival outside the womb."

Brigham provided abortions to five patients ranging from 18 to 33 weeks pregnant, according to a report by the New Jersey State Board of Medical Examiners.

The report said Brigham started the five late-term abortion cases in his New Jersey clinic, giving patients injections that either softened the cervix or caused "fetal demise."

The patients then traveled to Maryland where the abortions were completed, the report said.

Brigham completed some abortions himself and Riley completed others under Brigham's supervision, the report said.

Brigham's New Jersey medical license was suspended in October 2010 and he had received a cease-and-desist warning in Maryland a month before that.

Brigham argued to the board that the procedures in New Jersey were only preliminary to an abortion and that he only consulted doctors at the Maryland clinic.

Brigham has been held in a Camden County jail on $3 million bond since his arrest at his home in Voorhees, New Jersey.

Elkton police have ten days to pick up Brigham and take him to Maryland and typically the process is completed in a few days, Laughlin said.

Ellis Rollins III, the Cecil County State's Attorney in Maryland, where Brigham will be prosecuted, did not return calls seeking comment. Brigham's lawyer in Maryland, C. Thomas Brown, also did not return calls seeking comment.

Riley was arrested in Salt Lake City. A bond hearing will be held on January 9, when extradition proceedings to Maryland may be determined. Riley is in custody on a no-bond warrant.

Cops: Pharmacy robber, fed agent shot dead in NY

An off-duty federal law enforcement agent responding to an armed robbery at a pharmacy on Long Island was fatally shot along with the heist suspect, who had taken money and painkillers from the store before he was killed Saturday.

The off-duty Bureau of Alcohol, Tobacco, Firearms and Explosives agent died after being taken to a hospital with a gunshot wound, Nassau County police Lt. Kevin Smith said.

The ATF identified the fallen agent as 51-year-old John Capano, a 23-year veteran of the agency, who lived in Massapequa and was married with two children.

Rory O'Connor, assistant special agent in charge in the ATF's New York office, said Capano was a customer at the pharmacy when he chose to intervene in the robbery and apprehend the suspect. "During the course of the struggle, John was shot," O'Connor said.

He described Capano as a "very dedicated, aggressive agent" who, as a trained explosives expert, taught U.S. military and local forces in Afghanistan and Iraq how to do blast investigations.

"He was a veteran agent who did his job well," O'Connor said. "Even though off-duty, he felt the need to take action in an attempt to protect the public from a known robber."

Nassau County police said the unidentified man entered the pharmacy in Seaford and announced an armed robbery about 2 p.m., looking for painkillers and money. Police said that as the man was leaving the store, he was confronted by three individuals ? the ATF agent, an off-duty city police officer and a retired Nassau County police officer.

Shots rang out, and the suspect was struck, the painkillers and cash dropping to the ground, Smith said. The ATF agent also was wounded.

Smith said it was not immediately clear who shot the ATF agent, or how or why the off-duty officer and retired officer arrived at the location at about the same time.

Police declined to say what kind of weapon the robbery suspect was carrying.

The ATF agent was taken to Nassau County Medical Center in East Meadow, where he died. The NYPD officer and retired police officer also were taken to the hospital to be treated for trauma.

Police closed off the sidewalk with tape and covered the body with a white sheet while they investigated, said Razov Felice, owner of an Italian restaurant located down the street. Felice said the area has been struggling with a growing tide of prescription drug abuse.

"There is a lot of problem in Long Island with these drugs," Felice said. "I don't know what people are thinking. The more people talk about these drugs, the more people are trying them."

The shooting occurred about 30 miles west of another Long Island pharmacy where four people were gunned down by a drug addict during a robbery in June on Father's Day.

Nationwide, armed robberies at pharmacies rose 81 percent between 2006 and 2010, from 380 to 686, according to the U.S. Drug Enforcement Administration.

There have been a number of incidents in which New York-area police have fired at off-duty officers who were responding to a crime.

In March, an off-duty Metropolitan Transportation Authority police authority officer shot a Nassau County police officer who was in plainclothes and carrying a rifle. Both men were responding to a crime scene in the town of Massapequa Park.

In May, a New York Police Department officer shot and killed an off-duty colleague who was carrying a gun while chasing a suspected car thief in East Harlem.

In 2008, Westchester County police officers killed an off-duty officer from the New York suburb of Mount Vernon, N.Y. as he was intervening in a fight.

Texas airport: explosives found in man's luggage

A man has been detained at an airport in the US state of Texas after he tried to carry explosives through security, officials say.

The man was stopped at Midland International Airport when explosives in military wrapping were found in his carry-on baggage as it went through an X-ray machine.
He is being held by the FBI.
The airport terminal was cleared for checks, but normal operations have now resumed, say Midland city officials.
The FBI is conducting an investigation.
A spokesman declined to say whether the man was in military uniform, or what quantity of explosive he was carrying.
The man said that he was active in the military, according to police sources quoted by local newspapers.
He had reportedly been on a family visit to relatives in the Midland area and was returning to a base in North Carolina when he was detained

With 2011 nearing its close, the Reporter is taking a look back at the best that was in the world of Bellevue area sports and recreation. From now until the end of the year, we will recap the best moments, stories and athletes of our area.

Team of the Year - Bellevue football

The Wolverines captured a fourth straight Class 3A state title to make it nine since 2001 and second four-peat in the same span.

Bellevue's run is unprecedented in WIAA history and it is the only school to win three or more consecutive state championships in football in any classification. While the historical significance was not lost on players or coaches, the merits of this season alone are what give the Wolverines the edge for Team of the Year.

Consider the following.

Bellevue faced three teams that were ranked in at least one national poll in Oaks Christian (Calif.), Skyline and Lakes and defeated each, none by fewer than 10 points.

Skyline quarterback Max Browne was intercepted only five times all year in leading his team to the 4A state title and earning Gatorade Player of the Year for Washington. Against Bellevue, he tossed two of those five picks, one that was returned for a score. For the season, Browne tossed a ridiculous 43 touchdowns, but he managed only a single scoring pass against the Wolverines.

Lakes averaged 53 points in 11 games leading up to the state quarterfinal matchup with Bellevue and scored 60-plus five times. The Lancers managed only 14 in the only loss of the year to the Wolverines.

Fire Near Ford Theatre Under Investigation

A brush fire near the 101 freeway Friday evening has been extinguished, according to Los Angeles City Fire officials.

Authorities are investigating the cause of the blaze that occurred near Barham and Cahuenga boulevards.

A dozen firefighters extinguished the 20-foot by 20-foot grass fire near the John Anson Ford Theatre shortly after it was called in at 6:22 p.m.

Caucuses looming, Paul to spend weekend in Texas (AP)

SIOUX CITY, Iowa ? Republican presidential candidate Ron Paul is at or near the top of polls in Iowa, where he's drawing big crowds and has an enviable campaign organization. But with Iowa's caucuses on Tuesday, the Texas congressman plans to head home for the weekend, the latest evidence of an unconventional approach to winning the GOP nomination.

From his low-tech events and his relatively small entourage to his reluctance to glad-hand voters, the 76-year-old Paul has stubbornly adhered to his own campaign playbook with seemingly little regard for the calendar or the shifting dynamics of the GOP field.

The rest of the contenders braced for a grueling weekend of campaign events. Paul, however, planned to fly home late Friday night to spend the weekend with his wife, Carol. He was set to appear on several Sunday morning talk shows from Texas, and was scheduled to return to Iowa by Monday morning for a "whistle-stop" campaign tour with his son, Sen. Rand Paul, a Kentucky Republican.

"He's a family man and he wants to spend time with his family," said Paul's Iowa campaign chairman, Drew Ivers.

Leaving Iowa just three days before the kickoff nominating contest of the 2012 election is one of many quirks that set Paul's campaign apart from the more traditional presidential hopefuls.

Paul's schedule is a model of efficiency. Events start on time, and he delivers the same remarks at each one, no matter the location or size of the crowd. He speaks favorably of Iowa's importance in the nominating process but never forcefully asks audience members for their vote.

His venues are typically stark ? no bunting, no music, no booming sound system. Voters sit quietly, as if listening to a university economics lecture.

Paul never strays from his message of limited government, free markets and the importance of the Constitution, even when the moment might call for a different approach ? like when a 10-year-old autistic boy asked Paul on Friday what he might do to help children like him.

"The most valuable resource for children, teenagers, college kids and adults is liberty. If we protect those liberties we will have the maximum amount of progress," Paul said. Later, he assured the boy he did not plan to slash health care for children or the elderly if elected.

Paul has refused to engage rivals like Mitt Romney, Newt Gingrich and Rick Santorum, even as they have stepped up their criticisms of his foreign policy views and his lack of legislative accomplishments in Congress. He also rarely criticizes President Barack Obama, insisting that both parties are responsible for excess spending and debt.

He saves his attacks for campaign commercials and interviews. He told Bloomberg News on Friday that he might not be able to support any of his rivals because they embraced the status quo in Washington.

"If ... they don't want to change anything on foreign policy, they don't want to cut anything, they don't want to audit the Fed and find out about monetary policy, they don't want to have actual change in government, that is a problem for me," he said.

Paul travels with a small band of trusted advisers including a son-in-law, Jesse Benton, who doubles as his campaign chairman. Two of Paul's adult granddaughters, Linda and Lisa Paul, have also joined him in Iowa.

Carol Paul has made only limited appearances with her husband, showing up at debates and other major events.
